Im about to get shafted by the ex for child maintenance?



Disclaimer:

Im not a twat, i dont mind giving anything for the little one but it does not cost £600 a week to feed and dress a 3 year old :o

mate ive been in the same situation.... they have you by the short and curlys !!!!.
i had to pay £397 for my lad from the age of 6 months !!!!!!!
they must think he needs dressing in Prada....

Hi mate, you don't really get shafted in family Law ( though it does seem that way) its a case of the Judge decideing what is right and proper, concidering your income in relation to your ex partner etc.
You can get a list from the Law society, then ask around for recomendations,( call criminal firms and ask who they would use etc) or you could contact a Farthers group to see who's considered the best in your area.

Having someone shit hot prob won't help alot with maintainance, but could help if contact issues become a prob.

I stoped working in law a long time, but we had the best family lawyer in the area, and people were being recomended to use by other firms all the time, so asking around does work.

if you have not organised and agreed to a maintenance payment scheme, then the good ole CSA will do it on means testing, so the more disposable income you have, the more you pay.

As for CSA, my ex pays me nothing a week for 5 kids.

Well i was told by her that she will be after £600 a week as that is what she is entitled too. Like i said before its just nuts for a 3 year old, and at the end of the day she will have more from me in 2 weeks tax free than the average person in the uk gets a month :o

If an adult is on the dole they get approx £50 a week, i just dont see how they can justify it.

The isle of man is looking very tempting :woot:

sounds like you definatley need a good solicitor, don't expect to be paying little if you are earning good money though, but she would have to justify also, that she NEEDS £600 a week, I would guess she would be hard pushed to make it feasable for £600 a month....

I run a home, a car and 5 kids on less than £600 a child a month, if I got that, I would be sorted BIG TIME

I must admit i'm finding it hard to be sympathetic like Ash.

What has what you earn in a week or month got to do with it:confused: £600 a week for a kid is out of order. I think it's a bit of jealously coming out there;)

i'm not disputing the £600 is a high amount, but compared to others that have to pay a far higher % of their salary over, i don't think he will be in quite the harsh situation many others are.

Look on the CSA website - on there is a calculator where you put in your monthly gross salary, and how many kids you are paying for and what their ages are. It then tells you roughly what the liability is.

£600 a week is stupid money unless your first name is something like "Sultan". I'm paying £79 a week for 2 girls aged 6 and 9 on an income of just under £30K. It's a big dent in the weekly finances but nothing like what your ex is after.

And it's best to come to a private arrangement so you pay her the money directly. That way if she doesn't declare it and still claims all her benefits she's the one that is going to get shafted by the CSA / HMRC. As my ex did.......

Oh and set up a Direct Debit or Standing Order if you go that route so you have proof of the money going over. Don't do it by cash whatever you do.

i did try to do it the out of court way but she insisted upon it, which is a bit of a pain as my solicitor is after £200 an hour and she gets legal aid :o

too right steve, if it wasn`t for the little one she would just be gone, luckily the house is mine and she has not contributed in any way so she cant get that.

It is the little one i feel sorry for and i know she will try every trick in the book to get what she can because she will be on legal aid. ;)

Doesnt matter if she hasn't contributed a penny to the house, she is legally entitled to half of everything (unless you signed a pre-nupt).

In a divorce they can also argue they a 'lifestyle' settlement i.e. they became accustomed to a certain lifestyle and why should they have to settle for anything less just because they are no longer with you

I seem to remember a recent case where the wife argued for half based on her non-financial contribution to the relationship over a number of years but the judge chucked it out. However, I am no legal expert and anyhoo it doesn't apply to our man here so we ought to draw a line under that facet of the discussion.

At the end of the day its a shame it didn't work out and as he says quite rightly it's the little 'un that will suffer as he didn't really ask to be involved and probably used a pawn in whatever games are played out in court.

the sister in law wasnt married to her ex but she lived with him for 5 years and as a common law wife she got half of every thing, and they can make you disclose you or your company full income,the csa are shits

As said above it is down to the judge sitting, I work for a large Family Law practice in Kent and have sat in on these hearings a few times, whilst both sides either through solicitors or by themselves will put their side across, I have found that judges tend to be extremely fair in their judgements and usually are able to ignore the BS from the legal teams.
At the end of the day the maintenance will be decided on your level of income, therefore a guy on £60K will pay a lot more than someone on £25K it all goes on your disposable income, you decided to have a child together and if you were living together you wouldn't begrudge them the money, why should that change because you have split up?
Any order given can be varied after a year, but only if your circumstances have changed.
So if you don't want to pay that much then you could always go on the dole:D

Carl, she must have had her name on the deeds and helped with the mortgage etc.

I dont begrudge giving my daughter anything, if i knew the 2400 a month would be spent on her i would give it to her but im sure everyone can see that it will not be spent purely on her.

I have a ltd Company so profits are my companies and not mine so if i pay myself just 3k a month for the mortgage is she still entitled to anything as i have no disposable income?

If this is not possible i can move my company to a tax haven if needs be.
