ok i need to vent a little..

my grandson wanted a new bike for his birthday this weekend,so we have ordered him a wethepeople crysis bike from onyerbike.

orderd and payed for it monday afternoon,get an email this morning from them this morning(friday)

We are currently awaiting stock of WeThePeople Crysis we have a date of 29/10/08 into us then shoudl arrive shortly after this date to you - We would like to know if you are ok to wait?

now why couldnt they tell me they didnt have any monday..im absolutely fuming,they took the money for the bike knowing they didnt actually have any instock,thats more what im ****ed about.

if i had known they didnt have any i would have ordered elsewhere,now i have to tell my grandson he wont be getting a bike this weekend.

im livid but im too scared to ring as i know i will go off on one(im a tad short tempered when it comes to incompetent people)

now,are they legally entitled to take money for something without actually having the item instock WITHOUT informing me first?

they need to make this right with my grandson,if i have to lean on them a little i need some ammo first.

i'd ring up and ask for a refund/cancelation they should notify you when an item is in stock or not, i'd be pretty dam angry like you if were in your shoes, or i'd try talk them into giving you some extras like mark said

if you have bought it online, you come under the distance selling regulations, which gives you a 7 day cooling off period, with which you can cancel your order.

When they advertise, they must show the delivery arrangements, how long it will take to get to you. Now, they grey area is that whether they have to show stock levels. As they haven't been upfront and given you the stock issue right away after purchase, I think you will be well within your rights to expect a full refund with no stock handling charge deducted.

Only thing is, you got to be firm with them, but calm too.

they rang me about an hour ago explaining that it was the suppliers fault blah balh etc etc..and they are getting some in next week.

they offered me a refund,i pointed them to their own terms and conditions which said they do not charge you until the item is ready for shipping..he didnt know what to say.

its not the money its the fact i have to explain to daniel why his bike wont be here this weekend for his birthday when the shop had agreed to supply the bike by taking payment as per their own terms and conditions.

when i pointed this out to him he said he was going to change the t&c today..well not before i printed them out and got a screenie.

On Yer Bike update stock availability continuously. In the rare event of a product being unavailable we will endeavour to contact you before shipment for confirmation on how we should proceed. You will not be charged until your order is ready for shipment."
