Hi, jus bought an xbox with....... WITH XBOX LIVE ACCOUNT AND 14 MONTHS GOLD MEMBERSHIP from another oopler, dont want to mention name just yet, have wrote to him 3 times now in 24 hours with no reply.

There was quite a few games too. But since ive had it, I havent been able to use the xbox live account, because who ever owned it before is still using this facilty.

I was on it when I set it up, but then the other geezer signed in so that knocked me offline. Now he has somehow changed the sign in details.

Where do I stand now to question if this upto sale description??

I paid via paypal, not as gift. Would I be able to get money back???

To your question, in truth, not sure how you stand
In theory it has been received as item not as described
and as such you should be able to get your money back

But again not sure of the online ownership legality and paypal's interpretation of your purchase

If your not happy, log a dispute with Paypal and try

I think that bit is true as i`ve been through 2 xboxes and 2 hard drives upgrades.
So ive always just recovered my Live account and carried on playing. You can change your log in details whenever you want too i think.
Personnaly I`d wipe the hard drive and start anew.
